Video Review Submission Terms & Conditions

These Terms & Conditions ("Terms") govern the submission of video reviews, testimonials, photos, and related content ("Submissions") to Hey Old Sport, LLC ("Hey Old Sport," "we," "us," or "our"). By submitting content to us through any channel, including our website, email, social media, text, or a third-party review platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to submit content. If anyone under 18 appears in your Submission, you represent that you are their parent or legal guardian and consent to their appearance on their behalf.

2. License Grant

 

By submitting content, you grant Hey Old Sport a perpetual, irrevocable, worldwide, royalty-free, fully transferable, and sublicensable license to use, reproduce, edit, adapt, modify, translate, publish, distribute, publicly display, and perform your Submission, in whole or in part, in any media now known or later developed. This includes, without limitation, use on our website, product pages, packaging, email marketing, paid advertising, social media, and in-store or retail materials. Hey Old Sport will maintain the message of the video and will not use any version of it for other purposes than to communicate your truthful and honest review.

You retain ownership of your Submission. This license means we may use it freely without further permission, notice, or compensation.

3. Name and Likeness Release

You grant us the right to use your name, username, voice, image, likeness, and any biographical information you provide in connection with your Submission, for the purposes described above. You waive any right to inspect or approve the finished materials in which your Submission appears.

4. Editing

We may edit, crop, trim, caption, add music or graphics to, or otherwise modify your Submission at our discretion, provided the modification does not materially misrepresent your opinion of our products.

5. Your Representations

By submitting, you represent and warrant that:

  • You created the Submission and own all rights in it, or have permission from anyone who contributed to it or appears in it.
  • Your Submission reflects your honest, genuine opinion and actual experience with our products.
  • You will disclose any material connection to Hey Old Sport (such as free product, payment, or an ongoing relationship) in accordance with the FTC Endorsement Guides, and your Submission does not contain claims that would require substantiation we have not provided.
  • Your Submission does not contain third-party copyrighted material (including music), trademarks, or private information of others without authorization.
  • Your Submission is not false, misleading, defamatory, obscene, or otherwise unlawful.

6. No Compensation; No Obligation to Use

Unless we have a separate written agreement with you, you will not be paid or otherwise compensated for your Submission other than what is explicitly offered in exchange for a video submission. We are under no obligation to use, publish, or retain any Submission, and we may remove any Submission at any time for any reason.

7. Removal Requests

If you would like a Submission featuring you removed from channels we control, contact us at hey@heyoldsport.com. We will make commercially reasonable efforts to discontinue future use, but we cannot recall materials already printed, published, distributed, or shared by third parties.

8. Indemnification

You agree to indemnify and hold harmless Hey Old Sport and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your Submission or your breach of these Terms.

9. Privacy

Personal information you provide with your Submission is handled in accordance with our Privacy Policy, available at https://heyoldsport.com/policies/privacy-policy.

10. General

These Terms are governed by the laws of the State of [North Carolina], without regard to conflict of law principles. If any provision is found unenforceable, the remaining provisions remain in effect. We may update these Terms at any time; the version in effect when you submit applies to that Submission.
